Almighty,
Gross injustice is happening to millions of innocent, honest people in name of this or that rule and attributing it to CONSTITUTION. It is 62 years since archiac, control mechanism, RESERVATION was introduced as EXPERIMENT. It has been extended continuously through a this or that and has upset entire families.

Prayer that ways and means enable for all to be happy though humanly possible ways. Prayer that dependence of one man on another through artificial, unsustainable ways be abolished. Prayer that RESERVATION per se GOOOOOOOO once for all. Prayer that so called GOVERN-ment mechanism per se GOOOOOO and be replaced by new ways. Let man be contributor to universal welfare. Let him bring about joy, happiness to every universal creature and not create misery to any creature at all, the way that he is doing currently.

Man, the most advanced of all creatures, in conjunction with thousands of years of civilisation has evolved technologies that can render happiness to every creature of God, universe per se. Let man be contributor and not plunderer. Let parasitic ways be replaced by ways to contribute.

		<description>There has been a final adjudication of the dispute with regard to OBC reservation. From The perspective of Youth For Equality we would like to bring out the following Points.

1.     Economically and Socially backward classes of people must be included in the list of beneficiaries which a path breaking achievements for us.

2.     We have succeeded in our endeavor of getting the creamy layer excluded

3.     Educational Backwardness cannot be claimed beyond graduation

4.     Periodic review of beneficiaries every five years which would imply that the Govt must collect periodic data.

5.     Till today there is no list of beneficiaries. If the Govt tries to bring in undeserving groups in the list of beneficiaries who are not socially and economically backward the list shall be open to challenge.

6.     The list that the Govt may bring has to be that of socially and Educationally backward classes plus socially and Economically backward classes. If the Govt brings in a list of OBCs under the scheme of article 15, our understanding is that it shall fail the test of judicial review. As such the judgment clearly points out that such a notification of list shall be open to judicial review.

  

 

              The fight to get the Economically and Socially backward classes included in the list of beneficiaries and also to Oppose caste based reservation shall continue as their shall be a periodic revision of the beneficiaries every 5 years and create an equal opportunity society for all

Mr. Justice Bhandari virtually ruled out any quotas for OBCs in the IIMs, saying that a graduate (the basic qualification to enter IIM) was educationally forward and “ineligible for special benefits.” Since three of the Judges had stated that graduation was the benchmark for determining backwardness, it was interpreted to mean that graduates from among OBCs would be ineligible for admission to IIMs.

But, significantly, while Mr. Justice Bhandari talks about the exclusion of ‘graduates,’ Mr. Justice Pasayat favours the identification of the socially and educationally backward classes with ‘graduation’ as the basis; nowhere does he talk about excluding graduates. Thus, Mr. Justice Bhandari’s observations must be construed as a minority view that is not binding on the other four judges, it is being pointed out.
